Acceptance of Terms
By accessing or using Marqos AI (“the Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users of Marqos AI, including free and paid plan subscribers. By creating an account, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.
Service Description
Marqos AI is an AI-powered marketing analysis platform that provides:
- Marketing health reports generated by analysing your website and brand presence
- An AI CMO assistant (“Nova”) for ongoing marketing guidance
- Integration with Google Search Console and Google Analytics 4 (optional)
- 90-day action plans and dimension-based scoring across brand, SEO, social, and more
The Service is provided on an “as is” basis. Reports are generated using AI and are intended as guidance only — they do not constitute professional marketing, legal, or financial advice.
User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information when creating your account and to keep this information up to date. Each account is for a single user — you may not share your account with others.
You must notify us immediately if you believe your account has been compromised at hello@marqosai.com.
User Responsibilities
You agree that you are solely responsible for:
- The accuracy of the website URLs, brand information, and social media links you submit
- Ensuring you have the right to submit any URLs, including competitor URLs, for analysis
- How you use, interpret, and act on the reports and recommendations provided
- Compliance with all applicable laws in your jurisdiction when acting on AI recommendations
- Any Google integrations you connect — ensuring you have permission to access the associated data
Prohibited Uses
You may not use Marqos AI to:
Violation of these prohibitions may result in immediate account suspension without refund.
Payment & Subscriptions
Plans & Billing
Marqos AI offers a free plan and paid subscription plans (Starter, Pro, Agency). Paid plans are billed monthly in advance. Prices are displayed in Malaysian Ringgit (RM) but may be converted to your local currency by your payment provider.
Payment Processing
All payments are processed by Lemon Squeezy. By purchasing a subscription, you also agree to Lemon Squeezy's terms of service. We do not store your payment card details.
Auto-Renewal
Subscriptions renew automatically each month until cancelled. You will receive a receipt email from Lemon Squeezy for each billing cycle. You can cancel at any time from your account settings or by emailing us.
Plan Limits
Each plan includes a monthly report allowance and chat message limit. Unused credits do not roll over. Limits reset on the 1st of each calendar month.
Refund Policy
7-Day Money-Back Guarantee
If you are not satisfied with your paid subscription, you may request a full refund within 7 days of your initial purchase. This guarantee applies to first-time subscribers only and does not apply to renewals.
To request a refund, email hello@marqosai.com within 7 days of payment with the subject line “Refund Request”. Include your account email and reason for cancellation. Refunds are processed within 5–10 business days.
We reserve the right to decline refund requests where there is evidence of abuse (e.g. generating the maximum number of reports and then requesting a refund).
Intellectual Property
Our Property
The Marqos AI platform, including its software, design, branding, prompts, and algorithms, is owned by Marqos AI and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our express written consent.
Your Reports
The marketing reports generated for your business are yours to use. You may share, download, or use them in your business activities. However, you may not resell or redistribute reports as a service to third parties without a written agreement with us.
Your Content
You retain ownership of all content you submit (brand profiles, URLs, logos). By submitting content, you grant us a limited licence to process and analyse it solely to provide the Service. We do not use your data to train AI models.
Limitation of Liability
To the maximum extent permitted by applicable law, Marqos AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
AI Disclaimer: Reports and recommendations generated by Marqos AI are produced by large language models and may contain inaccuracies. They are provided for informational purposes only and should not be the sole basis for significant business decisions. Always apply your own judgement.
Termination
By You
You may close your account at any time from Settings → Account → Delete Account. Cancelling your subscription downgrades you to the free plan; it does not delete your account or data.
By Us
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. In cases of clear Terms violations, we may terminate without prior notice and without refund.
Effect of Termination
Upon account deletion, all your data (brand profiles, reports, integrations) is permanently deleted from our systems within 30 days. This action is irreversible.
Governing Law
These Terms are governed by the laws of Malaysia. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a notice within the application. The “Last updated” date at the top of this page indicates when the Terms were last revised. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, please stop using the Service and cancel your subscription.
